These Terms of Service are an end-user licence agreement (EULA) between you and the developer of Qwing for the use of the Qwing application and service. Qwing is a tool for private, user-to-user communication. By installing or using Qwing, you agree to these terms. If you do not agree, do not use the app.
1. Eligibility
You must be at least 17 years old to use Qwing. By using the app you confirm that you meet this minimum age and that your use of the service is lawful in your jurisdiction. If we learn that an account belongs to someone under 17, we will remove it.
2. Licence & nature of the service
Qwing grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for lawful personal communication. Qwing is a conduit for communication between users; we do not author, monitor, or have access to the content you exchange — it is end-to-end encrypted and not visible to us.
3. Your account
Your identity in Qwing is a cryptographic key pair generated on your device. The server stores only the public half. We cannot recover your account if you lose access to the device and your recovery phrase — there is no password reset, no support backdoor, and no out-of-band reset.
You are responsible for:
- Keeping your unlock PIN and recovery phrase private, and choosing a PIN that is not trivially guessable.
- Keeping your device physically secure — anyone with access to an unlocked device with Qwing installed can read your messages and send as you.
- Verifying contacts using the in-app safety number / SAS before treating a channel as resistant to interception.
4. Acceptable use
You agree not to use Qwing to:
- Create, send, request or store child sexual abuse material (CSAM) or any content that sexualises or exploits minors.
- Send content or engage in conduct that is illegal under the laws applicable to you or your recipient, including terrorism, trafficking, or incitement to violence.
- Harass, threaten, stalk, defame, or impersonate any person.
- Send spam, bulk unsolicited messages, or run automation that abuses the service or its rate limits.
- Attempt to compromise other users' accounts, exploit vulnerabilities, or interfere with the operation, integrity or security of the service.
- Use a modified client against the production service to bypass security controls or abuse limits.
5. User content & abuse
You are solely responsible for the content you send through Qwing. Because the service is end-to-end encrypted, we cannot read your messages and we will not attempt to. That makes responsible use a shared obligation:
- You must not send illegal content, and you must not use the service to facilitate illegal activity.
- Qwing provides in-app tools to report a user or message and to block a contact. Use them if you receive abusive, illegal or unwanted content.
- When a report is submitted, we can act on identifiers available to the server — for example, revoking delivery tokens and blocking the offending public key at the server level. We cannot retrieve message content, so reports should include independently observable evidence where possible (for example, a screenshot from the receiving device).
- Violators may be removed. We may suspend or terminate access for users who breach these terms, who threaten the integrity of the service, or where we are compelled to act by a competent authority under applicable law.
6. The self-custodial wallet
Qwing includes a self-custodial wallet. Your keys are derived from your recovery phrase and stored only on your device. The app signs and broadcasts real, irreversible transactions to public blockchain networks through third-party providers. By using it you accept full and sole responsibility for your keys, your recovery phrase, and every transaction you originate.
We never take custody of your funds and cannot reverse, freeze, cancel, or recover any transaction or any lost funds, and we accept no liability for any loss arising from on-chain activity, third-party providers, smart contracts, or your own key management. 7. Service availability & “as is”
The service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We aim for high uptime but do not guarantee it; outages, delivery delays and dropped calls can occur. Qwing is not a substitute for emergency services — do not use it to contact 112, 911, or any other emergency line.
8. Limitation of liability
To the fullest extent permitted by applicable law, the developer of Qwing and its contributors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, funds, profits, or goodwill, arising out of or related to your use of the service. Our aggregate liability for any claim is limited to fifty euros (€50) or the amount you paid us in the twelve months preceding the claim, whichever is greater. Nothing in these terms excludes liability that cannot be excluded under applicable law, including your mandatory consumer-protection rights as an EU resident.
9. Termination & account deletion
You can delete your account at any time from inside the app (Settings → Delete account); see Account Deletion. We may terminate or suspend your account if you violate these terms, if your usage threatens the integrity of the service, or if a competent authority compels us under applicable law. Termination revokes your delivery tokens; messages already delivered to peers cannot be recalled.
10. Governing law
These terms are governed by the laws of the Republic of Lithuania and the European Union. Disputes that cannot be resolved informally fall under the jurisdiction of the courts of Vilnius, Lithuania, without prejudice to the mandatory consumer-protection rules of your country of residence within the EU.
11. Changes to these terms
Material changes will be announced in the app on next launch. Continued use after a change constitutes acceptance of the revised terms.
